Kindred Voyages Cancellation Policy Agreement

This Cancellation Policy outlines the terms under which guests may cancel participation in any trip or retreat organized by Kindred Voyages (“the Company”). By reserving a spot and submitting payment, you (“the Guest”) acknowledge and agree to the following terms:

1. 72-Hour Cancellation Window

Guests have 72 hours (3 days) from the time of their first payment to cancel their booking and receive a refund, minus the non-refundable 4.5% payment processing fee charged by Squarespace or any third-party payment processor.
If you are on a payment plan, your plan will be cancelled at the time of your refund.

After this 72-hour window, all payments are strictly non-refundable, and your payment plan (if applicable) will continue until the full balance has been paid.

2. Responsibility for Remaining Balance

After the 72-hour cancellation period, you acknowledge and agree that you are financially responsible for the full cost of your trip, even if you choose to cancel or stop making payments.

Because your spot is held exclusively for you and planning begins immediately upon registration, cancellations create losses that cannot easily be recovered.

You may transfer your spot to another traveler who is approved by Kindred Voyages in writing. Once a new traveler is approved, the replacement must assume all financial responsibilities for the trip.
The replacement traveler will not be entitled to a 72-hour cancellation window under any circumstance.

3. Travel Insurance

Kindred Voyages highly recommends that all guests purchase comprehensive travel insurance that covers trip cancellation for any reason. This is the best way to protect your investment should unexpected circumstances prevent your participation.

4. Company-Initiated Cancellations

In the unlikely event that Kindred Voyages must cancel a trip, guests will receive a full refund of all payments made directly to the Company. This refund will not include any third-party costs (such as flights, visas, or external travel arrangements) paid outside of Kindred Voyages.

5. Acknowledgment

By booking with us, you confirm that you have read, understood, and agree to abide by this Cancellation Policy Agreement.

RECREATIONAL ACTIVITY RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK, INDEMNITY AGREEMENT AND PHOTO RELEASE

Please read and be certain you understand the implications of booking.

Express Assumption of Risk Associated with Recreational Activities

I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with the recreational activity generally described as but not limited to snorkeling, surfing, yoga, boating, swings, dancing, hiking, motorbiking, tour of monkey forest, cultural and spiritual rituals and other outdoor activities, including the rental of equipment and transportation associated therewith in which I am about to engage.

Inherent hazards and risks include but are not limited to:

Risk of injury from the activity and equipment utilized is significant including the potential for permanent disability and death.

Possible equipment failure and/or malfunction of my own or others’ equipment.

This activity or portions of it takes place outdoors and therefore includes risks associated with exposure to elements, excessive heat, hypothermia, impact of the body upon the snow, encountering objects either natural or man-made, exposure to animals with the attendant risk of kicking, biting, shying away, running off or otherwise moving in an unanticipated manner causing injury and/or death.

My own negligence and/or the negligence of others, including but not limited to operator error and guide decision making including misjudging terrain, rapids, weather, trails, or route location.

Attack by or encounter with insects, reptiles, and/or animals.

Accidents or illness occurring in remote places where there are no immediately available medical facilities.

Fatigue, chill, and/or dizziness, which may diminish my/our reaction time and increase the risk of accident.

Kindred Voyages reserves the right to change the itinerary at any time and therefore incorporates the above risks to activities outside of the listed itinerary.

I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.

Release of Liability, Waiver of Claims, Indemnity Agreement and Photo Release

In consideration for being permitted to participate in the activity(ies) described above and related activities, I hereby agree, acknowledge, and appreciate that:

I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named persons or entities (herein referred to as “releasees”): Kindred Voyages and any affiliates.

To release the releasees, their officers, directors, employees, contractors, representatives, agents, and volunteers, vessels, and its parent and subsidiary affiliates from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releasees or otherwise. By executing this document, I agree to hold the releasees harmless and indemnify them in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.

I hereby release and authorize Kindred Voyages the right to take, edit, alter, copy, exhibit, publish, distribute, and make use of any and all pictures or video taken of me to be used in and/or for any lawful promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites, and other print and digital communications, without payment or any other consideration. This authorization extends to all languages, media, formats, and markets now known or later discovered.

I hereby give Kindred Voyages, its officers, directors, employees, contractors, vendors, affiliates, and agents, and its assigns, licensees, successors in interest, legal representatives, and heirs the irrevocable right to use and make photographs (still, film, tape, or otherwise), to use and record with a video or audio recording device, my name (or any fictional name), picture, portrait, photograph, and/or likeness in all forms and in all media and in all manners (“Likeness”), without any restriction as to changes or alterations (including but not limited to blurring, distortion, alteration, optical illusion or use in composite form, or derivative works of my Likeness made in any medium, whether intentional or otherwise) in connection with the activity(ies) through the Company’s business, products and/or services, including but not limited to for advertising, for publication or any other lawful purposes.

I waive any right to inspect, modify, or approve any intermediary version(s) or finished version(s) of the results of the use of my likeness (“Results”). I waive any right to further compensation.

By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this Agreement. This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforceable.

Acknowledgment

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY BOOKING A TRIP AND AGREEING TO ALL TERMS AND CONDITIONS, AND I AGREE WITH THESE TERMS FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I REPRESENT THAT I AM OVER 18 AND LEGALLY COMPETENT TO EXECUTE THIS AGREEMENT, WHICH SHALL BE A BINDING COMMITMENT.

Code of Conduct

1. Trip Details:

I, ____________________________(Guest Name), acknowledge that I am participating in the __________________________________ [Trip Name] organized by Kindred Voyages ("Company"). I understand that the Company is responsible for planning, booking, and organizing the Trip, while the Influencer or group trip leader is responsible for promoting and hosting the Trip.

2. Trip Payment and Cancellation Policy:

I acknowledge that the total cost of the Trip is ______________________ [$Total Cost]. I understand that there will be no refunds issued for any reason, including cancellations, changes in plans, or unforeseen circumstances. I am aware that I am responsible for the full payment of the Trip, even if I cancel partially into making my payments and still have a balance due.

3. Trip Insurance:

I acknowledge that Kindred Voyages highly recommends that I protect my investment by obtaining trip insurance from Rene Care or any other reputable provider. I understand that trip insurance can provide coverage for unexpected cancellations, trip interruptions, and other unforeseen events.

4. Release of Liability:

I hereby release Kindred Voyages, its officers, employees, contractors, and agents from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses (including legal fees) arising out of or in connection with my participation in the Trip. I understand that participation in the Trip involves certain risks and uncertainties.

5. Natural Disasters and Emergencies:

I understand that in the event of a natural disaster, act of God, unforeseen emergency, or any other circumstance beyond the reasonable control of Kindred Voyages, which results in the cancellation or postponement of the Trip, Kindred Voyages shall have the discretion to determine whether to issue refunds, reschedule the Trip, or take any other necessary actions. I acknowledge that Kindred Voyages shall not be held liable for any losses, damages, or claims arising from such situations.

6. Protection of Group Trip Leader:

I agree to treat the group trip leader with respect and follow their instructions during the Trip. I understand that the group trip leader has the right to terminate my participation in the Trip if I do not comply with their instructions or if my behavior is deemed disruptive or inappropriate. In the event that my participation is terminated, I acknowledge that no refunds will be provided by Kindred Voyages.

7. Trip Rules of Conduct:

I understand and agree to abide by the following rules of conduct during the entirety of the Trip:

a. Respect and Courtesy: I will treat all participants, including the Influencer or group trip leader, other guests, and locals, with respect and courtesy. I will refrain from engaging in any behavior that may be considered offensive, discriminatory, or disruptive.

b. Compliance with Laws: I will adhere to all applicable local laws and regulations at the Trip destination. This includes respecting local customs, traditions, and cultural norms.

c. Responsible Behavior: I will not engage in any illegal or reckless activities that may endanger myself or others during the Trip.

d. Alcohol and Substance Use: If alcohol is consumed during the Trip, I will do so responsibly and in accordance with the local legal drinking age. I understand that the use of illegal drugs or excessive consumption of alcohol is strictly prohibited.

e. Timeliness: I will adhere to the schedule provided by Kindred Voyages and will be punctual for all activities and departures.

f. Participation: I will actively participate in group activities and follow the instructions provided by the Influencer or group trip leader. I understand that participation is a key aspect of enhancing the overall experience for all participants.

g. Respect for Property: I will treat accommodations, transportation, and facilities with respect, keeping them clean and undamaged. Any damages caused by me may result in additional charges.

h. Communication: I will communicate openly and respectfully with the Influencer or group trip leader regarding any concerns or issues that may arise during the Trip.

i. Termination: I understand that failure to adhere to these rules of conduct may result in the termination of my participation in the Trip without refund or compensation.

8. Media Release Consent:

I hereby grant Kindred Voyages and its affiliates, including the group trip leader, the right to capture, record, and use photographs, videos, and audio recordings of me during the Trip. I understand that these media materials may be used for promotional purposes, including but not limited to social media, the Company’s website, advertising materials, and other marketing initiatives.

I acknowledge that I will not be compensated for the use of these media materials. I understand that while Kindred Voyages and its affiliates will make reasonable efforts to respect my privacy and comfort, I release them from any liability arising out of the use of these media materials.

I further acknowledge that I have no ownership rights to any media materials taken during the Trip, and I waive any claims or rights related to such materials.

9. Agreement Acknowledgment:

By signing this document, I acknowledge that I have read, understood, and agreed to the terms and conditions outlined above, including the deliverables provided by Kindred Voyages and the clauses related to payments, refunds, trip cancellation, chargebacks, and arbitration.

I further acknowledge and understand that by participating in the _________________________ [Trip Name], I release Kindred Voyages, its officers, employees, contractors, agents, and the group trip leader from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses (including legal fees) arising out of or in connection with my participation in the Trip, including any activities, excursions, and accommodations provided.

I agree to indemnify and hold harmless Kindred Voyages and the group trip leader against any claims brought by third parties arising out of my acts or omissions during the Trip.

I acknowledge that I have no ownership rights to any media materials taken during the Trip and waive any claims or rights related to such materials.

I further acknowledge that this agreement supersedes any prior discussions, agreements, or understandings.
